The Advisory Boards
The advisory board is in the constitution under the section 7 of the act, by the appropriate government. The main purpose of this is to coordinate the work of committees and sub-committees appointed under the section 5 of the act. Although, the according to the section 9 of the act, the advisory board shall only consist of persons being nominated by the appropriate government. Therefore, representing the employers and the employees in the scheduled employment.
Also, they shall be equal in number, and independent persons not exceeding 1/3rd of its total number of members. One of such independent persons shall be appointed as the Chairman by the appropriate Government. Though, itβs not necessary that the representative in the advisory board shall be of any particular industry. Or of each and every scheduled employment. An independent person in section 9 of this act is the one who is neither an employee nor the employer.
The central advisory board:
The Section 8 of the Act, states that the Central Government must appoint a Central Advisory Board for advising the Central & State Government. In the matters of fixing and revision of the minimum rates of wages. Also all the other matters concerning the Minimum Wages Act, and coordinating the work of the advisory board. Thus the Central Advisory Board should consist of the person to be nominated by the Central Government. Representing the employers and employees. Therefore the scheduled employment that shall be equal in number and independent persons not exceeding 1/3rd of its total number of members, one of such independent persons shall be appointed as the Chairman of the Board by Central Government.
