Temporary application of model standing order
The Section 12 of this, temporary application of model standing orders. The Act provides that for the period commencing on the date. On which this Act becomes applicable to an industrial establishment and ending with the date. Also, on which the Act comes into operation in that establishment. Thus, with the standing Orders as finally certified under this. Therefore, the prescribed model Standing Orders shall deem for the adoption in that establishment. And the provisions of Sections 9, 13 shall apply.
Where there are two categories of workers, daily rated and monthly rated. But the certified Standing Orders are in respect of daily rates workmen only. And then Model Standing Orders can be applied to monthly rated workmen (Indian Iron and Steel Co. Ltd. v. Ninth Industrial Tribunal, 1977 Lab. I.C. 607).
Provided that nothing in this section shall deem to affect any standing orders. Which are finally having the certification under this, Act. Before, the date of coming into force of the Industrial Employment Act, 1957. Under this Act and have come into operation in respect of any industrial establishment.
In the case where there are no certified Standing Orders applicable to an industrial establishment. Also, the prescribed Model Standing Orders shall deem for the adoption and applicable (1981-II Labour Law Journal 25).
