By virtue of Section 17(b) of the Registration Act, 1908 and Section 54, paragraphs 2 and 3, of the Transfer of Property Act, a sale deed requires compulsory registration
A registered instrument operates from the time of the execution of the document and not from the time of registration. As per Section 23 of the Registration Act a document of the nature of Sale Deed is accepted for registration within 4 months from the date of its execution.
If a Sale Deed is not registered
- Ownership of the immovable property would not pass to the buyer irrespective of the fact whether consideration has been paid or not.
- It will not be looked into as evidence of any transaction affecting such immovable property
