Obligations and responsibility of an employer
As per the Act, there are obligations and responsibility of an employer. Power of Commissioner to require from employers statements regarding fatal accidents:
Where a Commissioner receiving information that an employee has died as a result of an accident arising out of and in the course of his employment from any source. He may send a notice to the employee’s employer by registered post requiring him to submit. Within thirty days of the service of the notice, a statement giving the circumstances attending the death of the employee in the prescribed form. Also, in the opinion of the employer indicating it. Whether he is or is not liable to deposit the compensation on account of the death.
- Thus, if the employer is of opinion that he is liable to deposit compensation. Then, within thirty days of the service of the notice he shall make the deposit.
- While, if the employer states he is not liable to deposit compensation. Then he shall indicate in his statement the grounds on which he disclaims liability.
To submit reports of fatal accidents and serious bodily injuries
- Whereby any law for the time being in force, notice is required to be given to any authority, by or on behalf of an employer. Occurring of an accident in his premises which results in death or serious bodily injury. The person requires giving the notice within seven days of the death or serious bodily injury. S/he is liable to send a report to the Commissioner. Giving the circumstances attending the death or serious bodily injury in the prescribed form.
