Notice of claim for maternity benefit
The section 6 of the Act, deals with notice of claim for maternity benefit and payment thereof. Under the provisions of this Act, any woman employed in an establishment and has the entitlement to maternity benefit. May give a written notice in a prescribed form to her employer. The notice shall state her maternity benefit and any other amount to which she may have the entitlement under this Act. And maybe paid to her at the scheduled time or to the person she has nominated. Also, she will not work in any establishment during the period for which she receives maternity benefit.
Any woman, who is pregnant, must provide her employer with a notice. The notice shall state the date from which she’ll be absent from her work. Also, it shall not be a date earlier than six weeks from the date of her expected delivery. Thus, if any woman who is pregnant and has not provided notice regarding her pregnancy, to her employer. Then she may give such notice as soon as possible after or before the delivery.
Therefore, once receiving the notice, the employer then shall permit such woman to absent herself from the establishment of the work she serves there. For the period for which she’ll receive the maternity benefit. Also, for the period preceding the date of her expected delivery, the amount of maternity benefit shall be paid in advance to her by the employer.
