Important definitions
There are certain important definitions in the Act. Which are as follows:
Appropriate Government
The Appropriate Government means- under the control of the Central Government in respect of industrial establishments or a Railway administration or in a major port, mine or oilfield, the Central Government, and in all other cases of the State Government.
Certifying Officer
Under section 2 of the Act, A Certifying Officer means a Regional Labour Commissioner or a Labour Commissioner. It also includes any other officer appointed by the appropriate Government. Thus under this Act, to perform all or any of the functions of a Certifying Officer, by notification in the Official Gazette.
Employer
An Employer means the owner of an industrial establishment to which this Act is applicable. And also includes the following persons:
- A manager so named under Section 7 of the Factories Act, 1948.
- The head of the department or also any authority appointed by the Government in any industrial establishment under its control.
- Any person responsible to the owner for the supervision and also control of any other industrial establishment which is not under the control of Government.
Industrial Establishment
It means:
- an industrial establishment defined by Section 2(ii) as in the Payment of Wages Act, 1936, or
- thus a factory as defined by Section 2(m) of the Factories Act, 1948, or
- a railway as defined by Section 2(4) of the Indian Railways Act, 1890.
