The legal system of India at present only mandates registration of deeds recording transactions and does not look into the legal competence of the party seeking to create / transfer a right, title or interest in the property. This establishes at best a presumptive title of the owner and creates an uncertain situation leading to so many cases in courts to establish title. The Government of India to get over these problems has proposed the Land Titling Bill 2011, where a system of registering titles of property will be done, based on “Torrens System”. The Act is to provide for the ‘establishment, administration and management of a system of conclusive property titles through registration of immovable properties’.
