The employer and the overriding effect
This act to have the employer and the overriding effect under section 3 provides with the provisions of the act. This states that the act shall have effect notwithstanding anything inconsistent therewith contained in any other law or in the terms of agreement or service contract.
The duty of the employer
Under section 4 of the Act, no employer is allowed to pay less to women workers than men. Whether the remuneration is in cash or in kind. Therefore, such establishment or employment for performing the same work or work of a similar nature and employer shall not reduce the rate of remuneration of any worker. Also, the remuneration means the basic salary or wage; or any other additional payable things, either in cash or in kind. Same work here means the nature of work. This defines the nature of work requiring same efforts, responsibility and skills, for working under same work conditions.
No discrimination shall be there
Under section 5 of the, Act the employer during recruiting the employees shall keep in mind some important things. These include the nature of the work, condition of the employment or the service such as promotion, transfer, and training. The act doesn’t permit the employer to make discrimination in such matters. The women shall get the equal employment opportunity. No employer can deny the employment to women workers unless women are prohibited to be engaged in that particular work by law and orders.
