Definitions
There are different definitions under this Act:
Employee
Under section2, any person who is employed in an establishment or factory to do any work for remuneration
Employer
Any person who employs one or more than one person to do any work in an establishment or a factory. For remuneration and thus, includes any person entrusted with the supervision. And control of employees in such establishment or factory.
Employment Exchange
This means any office or place established and maintained by the Government. Either by the keeping of registers or otherwise. Thus, for the collection and furnishing of information, respecting:
- Persons seeking to engage employees.
- persons seeking employment for themselves, and
- Also, vacancies to which persons seeking employment may be appointed
Establishment means
An Establishment means any office or any place. Therefore, a place where it carries any industry, business, trade or occupation.
The establishment in Public Sector
Means an establishment owned, controlled or managed by
- The Government, or
- A department of the Government
Government Company
Under section Section 617 of the Companies Act, 1956 ( 1 of 1956). Hence, defined it as a corporation including a co-operative society. Thus, established by or under a Central, Provincial or State Act. Therefore, this is owned, controlled or managed by the Government of India;
The establishment in Private Sector
This means an establishment through which is actually not an establishment in the public sector. And also where employment of ordinarily twenty-five or more persons is there to work for remuneration.
