Definitions
Some of the important definitions under the Act are as follows:
Dependant:
Under section 2 of the Act, ‘Dependant’ is defined to mean any of the following –
- A widow, a widowed mother, unmarried legitimate or adopted daughter, legitimate or adopted son.
- A widower, a parent other than the widowed mother.
- Minor legitimate or adopted son/daughter, unmarried brother/sister, widow sister.
- Grandparents (maternal/paternal), parents, wife/husband’s parents.
The owner or occupier of the business or the work premises, also any managing agent appointed by the employer, or any incorporated person.
Employee:
The term ‘workman’ is omitted and replaced by the definition of employee, under section 2 of the Act. Therefore the employee’s definition is as a person who is –
- A railway servant, not permanently employed in any administrative district or sub-divisional office of the railway;
- Captain of an aircraft, or other members of the crew;
- A master, seaman or other members of the crew of a ship;
- Recruited by a company abroad for work;
- Also, a driver, helper or mechanic.
Wages:
The total emolument including all the benefits or privileges (being capable of estimate in money) is, therefore, termed as ‘Wages’. Though, it doesn’t count the travelling concession or travelling allowance paid by the employer. But it includes the overtime pay, dearness allowance, free accommodation, etc.
Seaman:
Under section 2 of the Act, it means any person forming the part of the crew of any ship, though excluding the master of the ship.
