Application of the act
Under Section 1, of the Act, the application of the act extends to the whole of India. Also, the Act, shall apply to the following:
- Every Factory; and
- Every other establishment consisting the employment of twenty or more persons on any day during an accounting year.
The appropriate Government, in the Official Gazette after giving notice, of its intention, not less than two months. Apply the provisions of this Act by notification with effect from such accounting year. As, may be specified, in the notification to any establishment. Also, including an establishment being a factory. Within the meaning of sub-clauses, of Section 2 of the Factories Act, 1948. As may be specified in the notification employing such a number of persons less than twenty. However, that the number of persons so specified shall in no case be less than ten.
The provisions of the Act, in relation to a factory or establishment to which itβs applicable. Shall have effect in respect of the accounting year. In the year 1964, commencing on any day. And, in respect of every subsequent accounting year.
Thus, the Act governs the establishment to which this Act applies. And shall notwithstanding the number of persons employed. Therein falls below twenty, or, as the case may be. Under section 3, the number specified in the notification issued under the provision.
