Communication and Training of Employees- Make sure the policy gets out to all your employees either through the employee handbook or in memo form or with pay packets or with the appointment letters. This training should be ongoing, to ensure that new employees are made aware of the standards of behavior you expect in your workplace, in addition to reinforcing these messages in the minds of existing employees.

Such training should include:

  • Identification of what constitutes ‘harassment’, bullying’ and ‘discrimination’ in the workplace, including examples; and
  • Clear expectations of the standards of behavior that you expect from your employees, including a strong statement on the company’s attitude and objectives regarding sexual harassment; and
  • A statement, with reference to the relevant anti-discrimination legislation, that workplace harassment, bullying and discrimination is against the law and may result in employees being personally liable for their actions as well as exposing the company to significant liability; and
  • An explanation of the grievance and complaint process that employees should follow if they are subjected to harassment, bullying, or discrimination in your workplace, including an assurance that such complaints will be handled sensitively and confidentially; and
  • Exploration of the consequences that may follow from breaches of the policy, including termination of employment; and information on where your employees can obtain further assistance.

After a sexual harassment complaint is reported, the employer may take this opportunity to educate the harasser by providing counseling services. The purpose of counseling is to raise awareness of this type of misconduct as well as other offensive behaviours that are sensitive and may be misinterpreted in the workplace. Some organizations also encourage counseling the victims to rebuild their trust and the mental state suffered from the incident.
