Infringement of a trade mark occurs if a person other than the registered proprietor in the course of trade, in relation to the same goods or services for which the mark is registered uses the same mark or a deceptively similar mark.

Infringement occurs in the following cases:

  • when an infringer takes the essential features of the mark or takes the whole of the mark and makes a few additions or alterations, 
  • when the infringer uses such a mark in the regular course of business, 
  • when the infringer prints the infringing mark in advertisements, invoices or bills.
